The Commissioner of the Maine Department of Marine Resources amends the emergency DMR Chapter 95.06(L), Area No. 26, Medomak River (Waldoboro, Bremen, and Friendship) amended on November 9, 2011. This amendment closes the rainfall conditional areas on the Medomak River due to rainfall exceeding one inch in a twenty-four hour period.

RULE TITLE AND SUBJECT: DMR Chapter 95.06(L), Area No. 26, Medomak River (Waldoboro, Bremen, and Friendship), amended on November 9, 2011 is amended as follows:

TITLE & TEXT OF RULE: DMR Chapter 95.06(L), Area No. 26, Medomak River (Waldoboro, Bremen, and Friendship)

A.   Effective immediately because of pollution, it shall be unlawful to dig, take or possess any clams, quahogs, oysters or mussels taken from the shores, flats and waters of the following areas:

1.   North of a line beginning at a red painted post located on Pine Point (Waldoboro) then running due east to a red painted post on the eastern shore.

2.   South of a line beginning at a red painted post located on Pine Point (Waldoboro) then running due east to a red painted post on the eastern shore AND north of a line beginning at a red painted post located 659 yards south of Pine Point (Waldoboro) and running due east to a red painted post on the eastern shore.  This area is classified as “Restricted,” and harvest requires a special MDMR permit.

3.   Bug Tussel, (Bremen and Waldoboro): north of a line beginning at a red painted post located at a small point of land on the northwest shore of the area known as Western Branch and continuing east across the cove to a red painted post on the opposite shore AND north of a line beginning at a red painted post located approximately 600 feet north of the southeast tip of the prominent point that divides the two major drainages of the area locally known as Bug Tussel which continues east to a red painted post on the opposite shore on Gross Neck.  This area is classified “Restricted,” and harvest requires a special MDMR permit.

4.  West of a line beginning at a red painted post located approximately 400 yards south of the Duck Neck launching ramp (Waldoboro), then running north approximately 1000 yards to the first point of land northeast of the ramp. This area is classified as “Restricted,” and harvest requires a special MDMR permit.

5.   Long Cove (Waldoboro): inside a line starting at a red painted post on the northwestern shore of Long Cove, approximately 1,300 feet from the tip of Farnsworth Point (Waldoboro), and running southeast to a red painted post located on the southeastern shore of Long Cove.  This area is classified as “Restricted,” and harvest requires a special MDMR permit.

6.   South of a line beginning at a red painted post on the tip of land northwest of Heath Road bridge (Bremen), then running in an easterly direction to a red painted post on the northern tip of the first point of land on Heath Road (Bremen).

7.   Within 500 feet from shore between the point of land at the end of Heath Road (Bremen) and the red painted post located on the eastern most point of land off Heath Road.

8.   Back River Cove (Waldoboro): inside and shoreward of a line starting at a red painted post on the southwestern most point of a prominent point of land located at the mouth of Back River (Waldoboro), then running southeast to the southernmost tip of Haystack Island, and then running northwest to a red painted post on the northern shore of Back River Cove.

9.   East of a line beginning at the southwest tip of Boot Neck (Friendship), then running southwest to the northeast tip of Wolsgrover Island AND northeast of a line beginning at the south tip of Wolsgrover Island, then running southeast to the southwest tip of Wharton Island, then running southeast to the south side of the lobster pound, ending at the shore end of Forest Lake Road.

B.   Effective immediately, due to intermittent pollution caused by rainfall, the shores, flats and waters of the upper Medomak River (Waldoboro) in the following area are classified as “Conditionally Approved,” and shall be closed to the harvest of clams, quahogs, oysters and mussels, when rainfall meets or exceeds 1” within a 24 hour period: south of a line beginning at a red painted post located approximately 659 yards south of Pine Point (Waldoboro) and running due east to a red painted post on the eastern shore; AND north of a line starting at the south tip of Hoffse Point on the eastern shore of the Medomak River, and then running in a westerly direction to the north tip of the point of land that forms the southeastern mouth of Meetinghouse Cove. This area is currently OPEN CLOSED.

C.   Effective immediately, due to intermittent pollution caused by rainfall, the shores, flats and waters of the upper Medomak River (Waldoboro) in the following area are classified as “Conditionally Approved,” and shall be closed to the harvest of clams, quahogs, oysters and mussels, when rainfall meets or exceeds 1” within a 24 hour period:  south of a line starting at the south tip of Hoffse Point on the eastern shore of the Medomak River, and then running in a westerly direction to the north tip of the point of land that forms the southeastern mouth of Meetinghouse Cove; AND north of a line beginning at the red painted post on the southern end of “Arthurs Shore,” then running in a northeasterly direction to a red painted post located on the point of land that forms the southern mouth of the unnamed brook on the eastern shore of Sampson Cove. This area is currently OPEN CLOSED.

D.  Effective immediately, due to intermittent pollution caused by rainfall, the shores, flats and waters of the Medomak River (Waldoboro and Friendship) in the following area are classified as “Conditionally Approved,” and shall be closed to the harvest of clams, quahogs, oysters and mussels, when rainfall meets or exceeds 1” within a 24 hour period: inside and east of a line beginning at the southwest prominence of Boot Neck (Friendship), then following the shoreline northeast approximately 300 yards to the southeast point on the unnamed point of land in the town of Waldoboro. This area is currently OPEN CLOSED.
